Judiciary Committee

In addition to providing oversight of the Department of Justice and the agencies under the Department's jurisdiction, including the Federal Bureau of Investigation, and the Department of Homeland Security, the Judiciary Committee plays an important role in the consideration of nominations and pending legislation. The Judiciary Committee is also charged with the consideration of all Article III judicial nominations.  These include Supreme Court nominations, appellate court nominations, and district court nominations.  The Senate Judiciary Committee also considers legislation, resolutions and other matters, as provided for in the Standing Rules of the Senate.  These areas include:

  • Civil liberties
  • Espionage and counterfeiting
  • Constitutional amendments
  • Federal courts and judges
  • Judicial proceedings, civil and criminal
  • National penitentiaries

 Subcommittee on Crime and Terrorism

The Subcommittee on Crime and Terrorism has jurisdiction over:

  • The Department of Justice's (a) Criminal Division, (b) Drug Enforcement Administration, (c) Executive Office for U.S. Attorneys, (d) Office on Violence Against Women, (e) U.S. Marshals Service, (f) Community Oriented Policing Services and related law enforcement grants, (g) Bureau of Prisons, (h) Office of the Pardon Attorney, (i) U.S. Parole Commission, (j) Federal Bureau of Investigation, and (k) Bureau of Alcohol, Tobacco, Firearms, and Explosives, as it relates to crime or drug policy;
  • The U.S. Sentencing Commission
  • Youth violence and directly related issues
  • Federal programs under the Juvenile Justice and Delinquency Prevention Act of 1974
  • Criminal justice and victims' rights policy
  • The Office of National Drug Control Policy
  • The U.S. Secret Service
  • Corrections, rehabilitation, reentry and other detention-related policy
  • Parole and probation policy
  • Anti-terrorism enforcement and policy and Department of Homeland Security
  • State Department consular operations as they relate to anti-terrorism enforcement and policy
  • Encryption policies and export licensing
  • Espionage laws and their enforcement.

  Subcommittee on Oversight, Agency Action, Federal Rights and Federal Courts

The Subcommittee on Oversight, Agency Action, Federal Rights and Federal Courts has jurisdiction over: 

  • Federal court jurisdiction, administration and management
  • Rules of evidence and procedure
  • Creation of new courts and judgeships
  • Bankruptcy
  • Legal reform and liability issues
  • Local courts in territories and possessions
  • Administrative practices and procedures including agency rulemaking and adjudication
  • Judicial review of agency action
  • Third party enforcement of federal rights
  • Oversight of the Department of Justice grant programs, as well as government waste and abuse
  • Private relief bills other than immigration
  • Oversight of the Foreign Claims Settlement Act.

Judiciary Committee

The Committee on the Judiciary has been called the lawyer for the House of Representatives because of its jurisdiction over matters relating to the administration of justice in federal courts, administrative bodies, and law enforcement agencies. Its infrequent but important role in impeachment proceedings has also brought it much attention. Any legislation that carries a possibility for criminal or civil penalties can be referred to the Committee on the Judiciary, so its legislative workload is substantial. Committe jurisdiction includes:

  • The judiciary and judicial proceedings, civil and criminal
  • Civil liberties
  • Constitutional amendments
  • Criminal law and enforcement
  • Federal courts and judges
  • Non-border enforcement of immigration
  • National penitentiaries

Subcommittee on Courts, Intellectual Property and the Internet

The Subcommittee on Courts, Intellectual Property, and the Internet has jurisdiction over: Administration of U.S. Courts, Federal Rules of Evidence, Civil and Appellate Procedure, judicial ethics, patent and trademark law, information technology, other appropriate matters as referred to by the Chairman and relevant oversight.

Subcommittee on Crime, Terrorism, Homeland Security and Investigations

The Subcommittee on Crime, Terrorism, Homeland Security, and Investigations has jurisdiction over : Federal Criminal Code, drug enforcement, sentencing, parole and pardons, internal and homeland security, Federal Rules of Criminal Procedure, prisons, criminal law enforcement, and other appropriate matters as referred by the Chairman, and relevant oversight.
