Release and Satisfaction of Judgment
For the sole consideration of Twenty-five Thousand Dollars and 00/100 ($ 25,000.00), the receipt and sufficiency of which is hereby acknowledged, the undersigned hereby releases and forever discharges ___ and ___, their heirs, executors, administrators, agents, officers, and assigns and all other persons, firms, or corporations liable, or who might be claimed to be liable, none of whom admit any liability to the undersigned, but all expressly deny any liability, from all claims, demands, damages, actions, causes of actions, or suits of any kind or nature whatsoever and particularly on account of all injuries, known and unknown, both to the person and property of ___, deceased, resulting in death or not resulting in death, that resulted or developed from an accident that occurred on or about May 4, 1986, at or near a point of 1,860 feet south of the intersection of McClelland Boulevard and 32nd Street in Newton County Missouri and the resulting death of ___ on or about May 4, 1986.
It is expressly understood and agreed that this release is being given and entered into under the terms and provisions of Section 537.060, RSMo 2000, and that in entering into this release and discharge of the aforesaid persons, the undersigned expressly reserve their rights against any other persons who might be considered tortfeasors by the terms of that statute, it being the intent purpose of this release to discharge from all liability ___ and ___, and any persons who might be considered to have derivative liability as a result of the actions of ___ at the time and place mentioned above, and that those persons and ___ be discharged from all liability to the undersigned, and from all liability for contribution or noncontractual indemnity to any other tortfeasors; that the terms of this settlement have been completely read and are fully understood and voluntarily accepted for the purpose of making a full and final compromise adjustment and settlement of all claims, disputed or otherwise, because of the injuries and damages above mentioned, and for the express purpose of precluding forever any further or additional claims arising out of the aforesaid accident. The undersigned hereby accepts a draft or drafts as final payment of the consideration set forth above.
The undersigned further acknowledges satisfaction in full of the judgment and costs entered by the court in this cause.
